Adduci, Mastriani & Schaumberg LLP was part of the team that successfully defended OSRAM GmbH, OSRAM Opto Semiconductors GmbH, and OSRAM Opto Semiconductors, Inc., respondents in the matter of Certain Light-Emitting Diode Products, Systems, and Components Thereof (III) (Inv. No. 337-TA-1168).
Administrative Law Judge Clark Cheney came to an initial determination on June 26, 2020, that a violation of section 337 of the Tariff Act has not been established in the importation into the United States, the sale for importation, or the sale within the United States after importation, of certain light-emitting diode products, systems, and components thereof based on allegations of infringement of U.S. Patent No. 7,095,053 and U.S. Patent No. 7,528,421 (Notice Of Initial Determination On Violation Of Section 337 And Recommended Determination On Remedy And Bond, June, 26, 2020).
The initial determination found that the complainants’ domestic industry products do not practice the ‘053 or ’421 Patent. In addition, the ’421 Patent was found invalid as anticipated and obvious and for failure to meet the written description requirement.
This decision is subject to review by the International Trade Commission.
